Terms of Service

Plain English first: use PenpAI honestly, don't do anything harmful, and we'll do our best to give you a great service. The details are below.

1. Acceptance of terms

By downloading, accessing, or using PenpAI, you agree to be bound by these Terms of Service. If you don't agree, please don't use the app.

2. Who can use PenpAI

PenpAI is available to users aged 13 and over. Users between 13 and 15 must have parental or guardian consent. Users under 13 are not currently permitted to use PenpAI.

By creating an account, you confirm that the birth year you provided is accurate and that you meet the age requirements above.

3. Your account

You are responsible for keeping your account credentials secure. Do not share your account with others. If you suspect unauthorised access to your account, contact us immediately at support@penpai.app.

You are responsible for all activity that occurs under your account.

PenpAI is a language learning tool. You agree not to use it to:

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. AI-generated content

The penpAIs you interact with are AI-generated. Their responses are produced by large language models and should not be treated as professional advice — linguistic, medical, legal, financial, or otherwise.

While we work hard to ensure conversations are appropriate and high quality, AI can, does and will make mistakes. If you encounter something that seems wrong or inappropriate, please let us know at support@penpai.app and we will try to address it as quickly as possible.

6. Your content

You own the content you create — your messages, your word bank, your penpal configurations. We do not claim any ownership over your content.

By using PenpAI, you grant us a limited licence to store and process your content solely to provide the service. We do not use your content for advertising or AI training.

7. Our intellectual property

PenpAI, its design, codebase, and all generated content (including penpal avatars) are the property of PenpAI's developer. You may not copy, reproduce, or distribute any part of the app without permission.

8. Payments and subscriptions

PenpAI offers a free trial. Paid subscription details, pricing, and billing terms will be published on our pricing page before any charges are made. You will always be informed clearly before being asked to pay anything.

Subscriptions are managed through the App Store (iOS) or Google Play (Android). Refund requests are handled according to Apple's and Google's respective refund policies.

9. Termination

You can delete your account at any time from within the app. All your data will be permanently deleted immediately.

We reserve the right to suspend or terminate accounts that violate these terms, engage in harmful behaviour, or for any other reason at our discretion. We will make every reasonable effort to notify you before doing so, in case you believe this decision is unjust.

10. Limitation of liability

PenpAI is provided "as is". To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability to you shall not exceed the amount you have paid to us in the twelve months preceding any claim.

We do not guarantee that the service will be uninterrupted or error-free, though we will always do our best.

11. Governing law

These terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Geneva, Switzerland.

12. Changes to these terms

If we make material changes to these terms, we will notify you via the app or by email at least 14 days before the changes take effect. Continued use of PenpAI after that date constitutes acceptance of the new terms.
